It depends on the state. In many states the claim is filed by the personal representative of the estate (the executor or administrator) on behalf of family members. In others, close relatives such as the spouse, children or parents can file directly. The statute in the state where the death occurred controls. ### How long do you have to file a wrongful death lawsuit? Most states allow two years, but some are shorter. Tennessee generally allows one year. The clock usually starts at the date of death, though some states measure from the injury, and claims against government agencies can require written notice much sooner. A lawyer licensed in the state should confirm the deadline. ### What is the difference between a wrongful death claim and a survival action? A wrongful death claim compensates the family for their own losses, such as lost financial support and companionship. A survival action is the claim the person who died would have had if they had lived, including their medical bills and pain and suffering before death, and any recovery goes to the estate. The two are often filed together. ### Can you file a wrongful death suit if there was no criminal conviction? Yes. A civil wrongful death case is separate from any criminal case and uses a lower standard of proof, a preponderance of the evidence. A family can sue even if no charges were filed or the defendant was acquitted. ### How much is a wrongful death case worth? There is no standard figure. Value depends on the person's age, earnings and family, the strength of the evidence, the state's damages rules and caps, and the available insurance. Be wary of anyone who quotes a number before reviewing the facts. ## Latest releases _Press releases are sponsored content issued by the organizations named._ - [Aquatic Attorneys Announces Pool Drowning Legal Case Focus](https://legalherald.com/news/2026/10/09/aquatic-attorneys-announces-pool-drowning-legal-case-focus/): Aquatic Attorney, Coral Gables, FL - [Meso Lawyer PA Adds Guide to Mesothelioma Injury Lawsuits](https://legalherald.com/news/2026/10/06/meso-lawyer-pa-adds-guide-to-mesothelioma-injury-lawsuits/): Meso Lawyer PA, Philadelphia, PA - [Aquatic Attorneys Expands Pool Drowning Legal Information](https://legalherald.com/news/2026/09/28/aquatic-attorneys-expands-pool-drowning-legal-information/): Aquatic Attorney, Coral Gables, FL - [Michael Schafle, Esq. - Meso Lawyer Launches Mesothelioma Resource](https://legalherald.com/news/2026/09/15/michael-schafle-esq-meso-lawyer-launches-mesothelioma-resource/): Meso Lawyer PA, Philadelphia, PA - [Schuster Jachetti LLP Expands Personal Injury Resources](https://legalherald.com/news/2026/09/14/schuster-jachetti-llp-expands-personal-injury-resources/): Schuster Jachetti LLP – Wilmington, DE, Wilmington, DE - [$26 Million Settlement Reached in Las Vegas Drowning Case: A Call for Stronger Pool Safety Measures](https://legalherald.com/news/2025/03/04/26-million-settlement-reached-in-las-vegas-drowning-case-a-call-for-stronger-pool-safety-m/): Aquatic Attorney, Las Vegas, NV - [$2 Million Settlement Secured by The Haggard Law Firm in Florida Negligent Security Wrongful Death Case](https://legalherald.com/news/2025/03/04/2-million-settlement-secured-by-the-haggard-law-firm-in-florida-negligent-security-wrongfu/): Haggard Crime Victim Attorney, Palm Beach County, FL - [$7.65 Million Settlement Secured by Haggard Crime Victim Attorney in Negligent Security Wrongful Death Case](https://legalherald.com/news/2025/02/18/7-65-million-settlement-secured-by-haggard-crime-victim-attorney-in-negligent-security-wro/): Haggard Crime Victim Attorney, Miami, FL ## Policies - [Sponsored content policy](https://legalherald.com/sponsored-content-policy/) - [Editorial standards](https://legalherald.com/editorial-standards/)
